This page specifies the warranty policy of K-Patents Oy (further “K-Patents”). The Finnish Sale of Goods Act (in Finnish “Kauppalaki”) or Convention on Contracts for the International Sale of Goods (CISG) as valid from time to time, specifically provisions on conformity of the goods or defects, shall be applied subject to the provisions of the actual sales contract or any other contract between K-Patents Oy, its distributor and the purchaser.
All K-Patents products are guaranteed to be free of material or workmanship defects. K-Patents provides a limited warranty that covers the repair or replacement without charge, chosen by K-Patents in its sole discretion, of any defected product or part that occurs within two (2) years from the date of delivery. The repair can only be done by nearest authorized K-Patents repair facility.
K-Patents provides a limited warranty that covers the repair or replacement without charge, chosen by K-Patents in its sole discretion, of any defected spare parts delivered by K-Patents that occur within one (1) year from the date of delivery. The repair can only be done by nearest authorized K-Patents repair facility.
Any accessories delivered with the order from K-Patents are warranted by the manufacturer of the accessory and K-Patents does not admit any additional warranty for the accessories.
Defected accessories should be returned to K-Patents that will handle the warranty replacement.
Warranty repair made by K-Patents or made at authorized K-Patents repair facility
All products manufactured by K-Patents shall solely be serviced at K-Patents or at nearest authorized K-Patents repair facility. For a list of authorized repair facilities, please contact K-Patents or visit www.kpatents.com.
If the product is covered by the warranty admitted by K-Patents it will cover all costs related to the repairs and spare parts needed for the defected product to be repaired under warranty. Liability of K-Patents is restricted to the cost related to the repairs and spare parts needed and thus K-Patents shall not be liable for any direct or indirect cost, damages or such resulting from or accumulated in connection to product becoming defected.
Warranty repairs do not extend the initial instrument or spare part warranty, which starts from the date of delivery. Warranty repair work performed shall have a one (1) year of warranty from the date of the service. In case of full replacement of an instrument to a completely new instrument the instrument shall have same warranty as a new purchased instrument subject to K-Patents then valid warranty for such an instrument.
In general the warranty admitted by K-Patents does not cover normal wear and tear of the product over time, or any products that are handled, installed or used against manufacturer’s guidance. User shall follow all preventive maintenance recommendations at all times, if such exist.
It is the buyer’s responsibility to select the product material and to ensure that the material is satisfactory for the intended service conditions. It is the manufacturer’s responsibility to ensure that a material conforms to the specification. Therefore the warranty admitted by K-Patents does not cover for example shortened life cycle or breakdown of an instrument in where the shortened life cycle or breakdown is due to customer’s material choice. An example of this could be as follows: If an instrument is used in a corrosive environment and chosen material in the instrument in question is not suitable for corrosive environment, warranty is void.
The warranty is void in the following situations:
• misuse of products or accessories
• any unauthorized alterations or modifications on products or accessories or faulty installation not conducted by K-Patents or other authorized entity
• misuse of spare parts
• misplace and use of the instrument or accessory outside its specifications such as ambient temperature, process temperature, process pressure, vibration or defects due to conditions of operation deviating from those anticipated or to improper use of the products or accessories
• repair of instrument by unauthorized personnel
• wear and tear of products, for example prism erosion
• deliberately damaging equipment
• false storing
Previous list shall not be interpreted as exhaustive. K-Patents shall have right to void the warranty claim shall the cause of the defect leading to a warranty claim accede or equal to the warranty void reasons listed above.
When returning instruments or spares to K-Patents you must fill a Request for Return Materials Authorization (RMA) prior to shipping any products or items to K-Patents.
